These Terms of Service ("Terms") govern your access to and use of the website at www.elevatedigital.solutions (the "Site"), operated by Elevate Digital Solutions LLC ("Elevate," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

1. About Us

Elevate Digital Solutions LLC is a digital marketing agency that helps local businesses grow online through online advertising, CRM systems and email marketing, website design and development, and Google Business Profile / local SEO optimization. We also offer an AI‑powered local SEO service under the name Rank With Eva; Elevate Digital Solutions LLC does business as ("DBA") Rank With Eva for that service. The Site provides general information about our business and services. Any services we provide to clients are governed by a separate written agreement between us and the client.

2. Use of the Site

You may use the Site for lawful purposes only. You agree not to:

• Use the Site in any way that violates applicable laws or regulations;
• Attempt to gain unauthorized access to the Site, its servers, or any connected systems;
• Interfere with or disrupt the operation, security, or performance of the Site;
• Use any automated means to access or scrape the Site without our permission;
• Use the Site to transmit harmful code, spam, or malicious content.

3. SMS / Text Messaging Terms

These SMS Terms govern participation in our text messaging program (the "Program"), which we operate under our Rank With Eva service. By opting in, you agree to these SMS Terms in addition to the rest of these Terms and our Privacy Policy.

3.1 Program Description. We send a mix of marketing and transactional/informational messages to individuals who opt in. Depending on your consent selections and interactions with us, messages may include marketing messages (promotions, special offers, news, and other promotional content about our services) and transactional / informational messages (responses to your inquiries, appointment/consultation confirmations and reminders, account or service updates, and other information related to services you have requested).

3.2 How We Collect Your Information and Obtain Consent. We collect your mobile phone number through the booking / scheduling calendar on our Rank With Eva page (www.rankwitheva.com). When you book a call, you are presented with clear consent disclosures and two separate, optional, unchecked consent checkboxes — one for appointment and account (transactional/informational) messages and one for marketing messages. You must take an affirmative action to opt in (checking one or both boxes) before any recurring messages of that type are sent, and you can complete your booking without checking either box. By providing your mobile number and opting in, you give us your express written consent to send recurring automated text messages of the type(s) you selected to the number you provided, including messages sent using an automatic telephone dialing system. Consent is not a condition of booking or purchase. You represent that you are at least 18 years old (or the age of majority where you live) and are the subscriber or customary user of the mobile number you provide.

3.3 Message Frequency. Message frequency varies depending on your interactions with us.

3.4 Message and Data Rates. Message and data rates may apply. We do not charge for the messages, but your mobile carrier's standard message and data rates may apply. Please contact your wireless provider for details about your messaging plan.

3.5 Opt‑Out Instructions. You can cancel the Program at any time by replying STOP to any message you receive from us. After you send STOP, we will send you a single confirmation message and will no longer send you Program messages. To rejoin, you can opt in again through the booking calendar or by replying START.

3.7 Carrier Disclaimer. Carriers (including, but not limited to, all major U.S. wireless carriers) are not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your wireless carrier and is outside of our control.

3.8 Privacy and Handling of Mobile Information. We respect your privacy. No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. Information sharing to subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties. Your mobile information and SMS opt‑in/consent data will never be sold. All other handling of your personal information is described in our Privacy Policy.

3.9 Changes to the Program. We may change or discontinue the Program, or update these SMS Terms, at any time. Material changes will be reflected by updating the "Last Updated" date above and, where required, by notifying you.

4. Intellectual Property

Unless otherwise noted, all content on the Site — including text, graphics, logos, images, and design — is the property of Elevate Digital Solutions LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without our prior written permission. The "Elevate Digital Solutions," "Rank With Eva," and "Eva" names and associated logos are our marks and may not be used without permission.

5. No Professional Advice

The information provided on the Site is for general informational purposes only. It does not constitute professional marketing, business, legal, or financial advice. Any reliance you place on Site content is at your own risk.
